TAX LOSS – Allstate Property and Casualty Insurance Company was hit by class action on Thursday in the Louisiana Intermediate District Court alleging that the insurer improperly excludes sales tax from its settlement payments for total loss vehicles. The lawsuit, filed by Herman, Herman & Katz and Normand PLLC on behalf of the Louisiana policyholders, argues that since sales tax is required on the purchase or lease of any vehicle, it is a mandatory component of the “value real redemption” of the car. Counsel has yet to appear for the defendant. The case is 3:22-cv-00247, Cummings v Allstate Property and Casualty Insurance Company. THE UNFORGIVEN – Junior lawyers in the UK are increasingly concerned that relatively minor mistakes could end their careers, particularly in light of recent action by the Solicitors Regulation Authority. This week the SRA dropped its case against a young lawyer who initially had her barristers’ license revoked for lying about the loss of a briefcase containing legal documents on a train. After a two-year ordeal – during which she lost her license to practice in 2020 and was granted a rehearing in the Barristers Disciplinary Tribunal – former Capsticks lawyer Claire Matthews can now resume her legal career, thanks to new medical evidence “diagnosing conditions relevant to his mental health. But, as Law.com’s Varsha Patel reports, several juniors and the industry at large have questioned why this case went so far in the first place and are skeptical about how similar cases might be handled in the future. Many also wonder if this treatment shows that junior lawyers are seen as more disposable than their senior counterparts. LawCare CEO Elizabeth Rimmer told Patel that Matthews’ case should be a “profession-wide trigger for how we are changing the way we respond to error”, pointing to a “culture fear and blame”. She added: ‘The big question is why didn’t Claire Matthews feel able to tell the truth about leaving the matter on the train?
